Tropicana Field Ticket Disclaimer
The holder of this ticket voluntarily assumes all risk and danger incidental to the game of Baseball, or other event for which this ticket is issued, whether occurring prior to, during, or subsequent to the actual playing of the game, including specifically (but not exclusively) the danger of being injured by thrown bats, fragments thereof, and thrown and batted balls or other objects, and the holder, by using this ticket, agrees that Major League Baseball ("MLB"), the American League, the National League, the Tampa Bay Rays ("Club"), other participating clubs, Tropicana Field, the City of St. Petersburg, Pinellas County, and Ticketmaster, including without limitation their respective players, other employees and agents and all other individuals and entities affiliated with such organizations, are not liable and are hereby held harmless by the holder for all injuries, expenses, claims and liabilities resulting from or related to any such causes. Resale of tickets on Tropicana Field property is specifically prohibited. Tickets obtained from sources other than the Club and its designated agents may be lost, stolen, or counterfeit tickets, which will not be honored at Tropicana Field, and the holder assumes all risk associated with the purchase of this ticket from any other source. All events are subject to date and time change, and any such change shall not constitute a reason for refund or exchange.
This ticket shall be honored only for this particular game or event and no part of the purchase price will be refunded by reason of the failure of the holder to use it for this game or event. The holder is subject to and agrees to abide by all the rules and policies established by the Club pertaining to all events held at Tropicana Field together with the applicable rules and regulations of MLB. By use of this ticket the holder consents to a reasonable inspection and search for items prohibited by Tropicana Field rules and policies. The Club reserves the right, without the refund of any portion of the ticket price, to refuse admission to or to eject any person from an event and to revoke season tickets if he or she fails or refuses to comply with the terms and conditions of this ticket and all applicable rules, regulations and policies, uses vulgar or abusive language or engages in conduct that is deemed by Tropicana Field management to be disorderly, unruly or disruptive. By use of this ticket, the ticketholder agrees that: (a) he or she shall not transmit or aid in transmitting any information about the game to which it grants admission, including, but not limited to, any account, description, picture, video, audio, reproduction or other information concerning the game (the "Game Information"): (b) the Club issuing the ticket is the exclusive owner of all copyrights and other proprietary rights in the game and Game Information, and (c) the Club, Major League Baseball Properties, Inc. and Major League Baseball Enterprises, Inc. shall have the unrestricted right and license to use his or her likenesses as included in any broadcast, telecast or photograph taken in connection with the game. Violation of any of the foregoing provisions of this paragraph will automatically terminate this license without any refund of any portion of the purchase price. In addition to the foregoing, this ticket is a revocable license and may be terminated and confiscated at any time and the holder refused admission or removed from the premises upon tendering to the holder the purchase price of this ticket stated hereon. This ticket may not be used for advertising, promotion (including contests and sweepstakes), or other trade purposes without the express written consent of the Club. This ticket must not be resold or offered for resale except as authorized by the Tampa Bay Rays, through the official website of the Rays (www.raysbaseball.com) or any other site authorized by the Rays, and in compliance with any federal, state and local law or regulation.

A partial season ticket plan must consist of at least 22 games and the tickets may be non-transferable as determined by the Rays in their sole discretion. The deposit may not be applied toward the renewal of any previously purchased Rays season tickets, single game tickets, or the Rays Flex Pack. A Rays representative will contact you by phone to select your 2016 season ticket location. Failure to purchase the required 2016 full or partial season ticket plan by April 1, 2016 will result in a forfeiture of the deposit and the priority number assigned.
Postseason ticket packages will be located in the Baseline Box, subject to availability, and will include all postseason games that may be played by the Rays at Tropicana Field in 2015. The number of postseason packages available for purchase will be equal to the number of deposits placed toward 2016 season tickets. All postseason requests are filled based on the order in which they are received and accompanied by payment in full. The 2015 postseason seats are mutually exclusive of the seats you can choose for 2016 season tickets. Any remaining balance from postseason games not played will automatically be applied toward your 2016 season tickets. You may also request a refund of the balance from postseason games not played by submitting a written request to the following address no later than November 14, 2015: Tampa Bay Rays, Attn: Season Ticket Sales Dept., One Tropicana Drive, St. Petersburg, FL 33705.
Any benefit associated with the purchase of Rays season tickets, including but not limited to any discount applied against the price of a new season ticket, the priority number system, and the opportunity itself to renew season tickets, may be withheld, adjusted and/or revoked by the Rays at any time with respect to any one or more individuals and entities as determined by the Rays in their sole and absolute discretion. As a season ticket holder with the Tampa Bay Rays ("Rays"), you are a valued and important part of our organization. To assure prompt and efficient response to your requests and needs, we kindly request your compliance with the following policies and procedures. By sending us payment for Rays season tickets, you indicate your willingness to comply with these procedures. Please read this information carefully. The terms "season ticket holder," "permanent rights holder" and "contact name" are collectively hereinafter referred to as "season ticket holder."
Ownership of Seat Locations
The Rays own and control all rights to seat locations for Rays home games at Tropicana Field (the "Stadium"). A purchaser of season tickets obtains a license, in the form of the ticket, to use the seat location at the Stadium designated by the ticket. The Rays in their sole and absolute discretion may revoke this license at any time upon refunding the purchase price printed on the ticket or at any time upon misconduct by the season ticket holder, without refund. This license is granted on a game-to-game basis, and is subject to all rules, regulations and policies relating to tickets as established from time to time by the Rays, the Stadium and Major League Baseball. The decision to offer partial season tickets and the composition of such plans will be made by the Rays from time to time in their sole discretion.
Season Ticket Holder and Accounts
For purposes of these Policies and Procedures, a Full Season Ticket Holder is defined as having purchased all home games at Tropicana Field or a prorated portion thereof. A Partial Season Ticket Holder is defined as having purchased a season ticket plan consisting of a portion of home games, usually similar in their days of the week. The Rays reserve the right to change the games included in partial season ticket plans from year to year.
The season ticket holder is the permanent rights holder (whether person or business) on the original application for tickets, and that person or business is assigned an account. If the season ticket holder is an entity, a contact name must be provided to the Rays. The entity may request a change in the name of the contact person for its account. A request to change the contact person of an entity must be submitted to the Rays in writing on company or entity letterhead and signed by an authorized officer. Season tickets should be paid for by check or credit card. If a third party payment is accepted by the Rays, such acceptance shall not give the third party any season ticket holder or renewal privileges, or cause or require the Rays to change the name of the season ticket holder on the account. The Rays will treat the season ticket holder as the purchaser of season tickets in such circumstances, including for purposes of season ticket renewal.
Season Ticket Privileges Non-Transferable
Season ticket holders are prohibited from transferring the seat locations designated by their season tickets to any person, whether by a request to transfer the account into another name, or by an attempt to transfer the seat locations or the renewal privilege described below by sale, gift, transfer by will or trust, property settlement, transfer to creditors, or any other means. It is important to the Rays to protect and reward Rays customers by allowing them the opportunity to relocate their seat locations, rather than allowing season ticket holders to transfer accounts or sell them to third parties. Therefore, any attempt to sell or otherwise transfer season ticket privileges to third parties will not be recognized by the Rays and may result in cancellation of all season ticket privileges. Any court order directing distribution of the season tickets to a person not listed as the season ticket holder, whether in bankruptcy or otherwise, may result in the exercise by the Rays of their right to immediately withdraw the license represented by the tickets, including any season ticket renewal privileges, upon refund by the Rays of all amounts paid for games that have not yet been played.
The Rays generally recognize two exceptions to the above policy. First, the Rays will generally allow season tickets to be transferred to members of the season ticket holder's immediate family upon the death of the season ticket holder. Immediate family shall be defined as a person's spouse and relatives by birth or marriage including siblings, parents, children, in-laws, and any financial dependents. A request to transfer season ticket privileges to an immediate family member of a deceased season ticket holder must be submitted to the Rays in writing by the deceased's personal representative or other authorized representative, and must be supported by appropriate documentation satisfactory to the Rays. Such documentation may include but not be limited to death certificate, probate and/or trust documents, and proof of relationship.
Second, if the season ticket holder is an entity, the Rays will generally allow season tickets to be transferred upon the sale or dissolution of an entity. A request to transfer season ticket privileges of an entity account must be submitted to the Rays in writing by the contact person for the account, and must be supported by appropriate documentation satisfactory to the Rays. Such documentation may include but not be limited to corporate resolution, asset or stock purchase agreement, and dissolution papers. The Rays reserve the right to approve or reject any such requests at their sole and absolute discretion.
Season Ticket Renewal Privileges
Subject to these policies and procedures, a full season ticket holder has an opportunity to renew the current assigned seat location at the Stadium for the next Rays season. The opportunity to renew is a privilege granted by the Rays and may be revoked at the Rays' sole and absolute discretion. This renewal privilege is exercised when payment is received for the season tickets in the amount specified and by the date established by the Rays. This renewal privilege is revocable by the Rays at any time prior to payment or if payment is not received by the established due date. A partial season ticket holder has an opportunity to renew seats for the next Rays season at the Stadium, but is not guaranteed the same seat location. If a partial season ticket holder's seat location is not available at the Stadium, the Rays will make reasonable efforts to relocate the partial season ticket holder to seats in the Stadium generally in the same price range and in the same general area as the partial season ticket holder's former assigned seat location. Partial season tickets will only be available in designated locations in the Stadium.
The Rays will exercise reasonable efforts to maintain renewal privileges for season ticket holders at the Stadium; however, season ticket holders are not guaranteed this opportunity. The Rays will take into account, among other things, violations by season ticket holders of rules, regulations and policies of the Rays, the Stadium and Major League Baseball in deciding whether to revoke renewal privileges. Such violations include, without limitation, any unapproved transfer or attempt to transfer rights to the seat locations represented by season tickets as discussed above. Any benefit associated with the purchase and/or renewal of Rays' season tickets, including but not limited to any renewal discount applied against the price of a new season ticket, the priority number system described in the next paragraph, and the opportunity itself to renew season tickets, may be withheld, adjusted and/or revoked by the Rays at any time with respect to any one or more individuals and entities as determined by the Rays in their sole and absolute discretion. In deciding whether to permit the renewal of season tickets as well as the price at which the tickets would be renewed, the Rays reserve the right to take into account, among other things, that a particular individual or entity resold an amount of their season tickets such that it appears to the Rays, in their sole and absolute discretion, that the individual or entity is possessing the season tickets primarily for resale purposes and not for their own personal use in attending games at Tropicana Field. The Rays further reserve the right to make adjustments to benefits as well as to make decisions on the renewal of season tickets on a case-by-case basis as well as on a year-to-year basis. In addition, renewal privileges could be effected from time to time by changes to the Stadium and/or the Stadium seating areas (such as, for example, the elimination of seats and/or damage or destruction to the Stadium or other events or circumstances) as determined by the Rays in their sole and absolute discretion. Season ticket renewal invoices will be mailed to the season ticket holder by the end of the calendar year, subject to the discretion of the Rays. The payment deadline date will be specified on the invoice. Due to the time required to process relocation requests, accounts not meeting the payment deadline are subject to cancellation. If you do not receive the appropriate mailings, please contact Season Ticket Services at (727) 825-3250. If you do not contact Season Ticket Services within a reasonable time, the Rays may revoke your renewal privilege and your priority numbers for seat locations. All payments received for season tickets are non-refundable and non-transferable.
The Rays have adopted the following policy for the assignment of a priority number to each new season ticket holder: (1) priority numbers are assigned sequentially as season ticket holders subscribe or have subscribed; (2) a season ticket holder's priority number determines the order to which season ticket seat relocations are offered to a season ticket holder; (3) full season ticket holders in designated premium locations receive the exclusive benefit of premium priority numbers enabling earlier access in the relocation process; (4) in the event a full season ticket holder relocates from one premium location to another premium category, they will be reassigned the next available priority number associated with the new premium location; (5) in the event a full season ticket holder relocates out of a premium location to a non-premium location, they will revert back to their general priority number as assigned when they subscribed; and (6) a priority number may only be transferred as designated in the Season Ticket Privileges Non-Transferable section of this document.
Distribution of Tickets
Fully paid season ticket accounts will receive their tickets approximately two (2) weeks prior to the first game of the regular season. Season tickets will be mailed to the season ticket holder or may be picked up at the Tropicana Field ticket office if requested in writing by the season ticket holder at the time of payment. A physical address is required for delivery.
Seat Location Changes
Requests for season ticket relocation are accepted during the renewal period. Your requests must be indicated on the season ticket relocation form (included with your invoice) along with your payment. Requests for seating changes will be considered by priority number along with other season ticket holders requesting changes. Relocation requests should indicate which areas of seating are acceptable. The request should identify the largest possible area that is acceptable for relocation and a possible increase in price. Relocations are limited by, among other factors, the actual cancellations that occur. If seats are available in the desired areas when your priority number(s) is reached, your seat(s) will be changed according to the request on the season ticket relocation form and all rights to previously assigned seats will be forfeited. The Rays reserve the right to adjust season ticket locations at any time without prior notice to or consent of the season ticket holder. Such adjustment may take place on a single game basis as needed or may be made for all or any portion of the season. Reasonable efforts will be made to contact the season ticket holder prior to any location adjustment. In the event of any such location adjustment by the Rays, the season ticket holder's sole remedy shall be cancellation of its account. The season ticket holder must provide the Rays with written notice of such cancellation within sixty (60) days after notification of the adjustment. Upon receipt of such notice, the Rays will refund to the season ticket holder any amounts paid which correspond to games not played as of the date which is five (5) business days after notice is received by the Rays. Tickets for remaining games must be returned to the Rays in order to receive said refund.
Additional Ticket Requests
If you wish to purchase additional season ticket seats, please contact the Rays at (727) 825-3250 to be placed on the waiting list. You will be notified after the relocation process as to what seats are available. Please be aware, additional seats will receive their own priority numbers, may not be adjacent to your current seat locations, and will be priced at the New season ticket price (renewal rates will not apply).Returned Checks
If any check is returned unpaid, the Rays or their authorized agent may then debit the season ticket holder's checking account for the amount of the check, a $40 service charge, plus any additional charges assessed by the financial institution as a result of the dishonored check. Payment by check constitutes acceptance of these terms. A returned check also may result in cancellation of a season ticket account in the Rays' sole discretion. The Rays reserve the right to refuse payment by personal check at any time.
It is the Rays' policy to accommodate as many season ticket holders as possible during any postseason play at the Stadium. Season ticket holders will have the first opportunity to purchase postseason ticket packages after the requirements of the Office of the Commissioner of Major League Baseball and the Rays organization have been met. Season ticket holders will be notified of specific policies and procedures prior to any postseason play.
Lost or Stolen Tickets
Lost or stolen tickets can be replaced only under the conditions set forth by Rays management, and only to the season ticket holder. Re-printed tickets will be issued upon payment of the full face value of the lost tickets. Reports of stolen tickets must be accompanied by a police report indicating the circumstances of the theft. Stolen tickets (with police report) will be replaced without additional charges. If lost tickets are later recovered, a refund of additional charges may be obtained by sending the unused lost tickets and the re-printed tickets to Rays Season Ticket Services, within thirty (30) days after the game for which you required the replacement tickets. Please contact Rays Season Ticket Services at (727) 825-3250 to determine eligibility for replacement tickets.
Change of Address
It is the season ticket holder's responsibility to notify Rays Season Ticket Services, in writing, of any change of address to insure prompt delivery of tickets, notices and other dated material. The season ticket holder must sign the change of address. Address changes may also be made through your exclusive access to My Rays Account on raysbaseball.com.
Notices and Requests
All notices and requests relating to a season ticket account, whether or not described above, must be given in writing by the season ticket holder, and sent to the attention of Rays Season Ticket Services. No notice or request will be effective or acted upon by the Rays until received in writing. All correspondence concerning a season ticket account should include the account number and daytime phone number for the season ticket holder. Notices and requests from the Rays are communicated to season ticket holders via several methods, independent of and/or in combination with each other, and include but are not limited to U.S. Postal Service, telephone or e-mail. It is the season ticket holder's sole responsibility to maintain accurate, current and complete contact information on their Rays season ticket account.
The foregoing policies and procedures attempt to cover most situations relating to season ticket holders at the Stadium. They do not apply to any games (home or away) played by the Rays at a location other than the Stadium. In the event any issue or matter relating to Rays season tickets is not covered, or if there is a question of interpretation of the policies and procedures or in the event of any dispute between the Rays and any season ticket holder, or any season ticket holder and a third party, the Rays reserve the right to make all final decisions and determinations and take all actions necessary, in their sole and absolute discretion, to resolve the issue or dispute. The Rays further reserve the right to modify and/or terminate any or all of the foregoing policies or procedures from time to time with or without prior notice to the season ticket holders.
In order to ensure an excellent experience for all Rays season ticket holders, season ticket benefits, including but not limited to, ticket exchange programs, promotional packages, personalized nameplates and commemorative ticket stock, are subject to change from year to year and/or within a season.
NO CONTRIBUTION OR PURCHASE NECESSARY TO ENTER OR WIN. The Tampa Bay Rays Baseball Club ("Sponsor") is sponsoring a single-prize chance drawing ("Raffle") to be conducted at each Tampa Bay Rays Major League Baseball regular season home game ("Game") played between the dates of April 4, 2015 and October 4, 2015 (the "Raffle Period"), at Tropicana Field (the "Stadium"), One Tropicana Drive, St. Petersburg, Florida 33705, during a time period at each Game (the "Entry Period") beginning at the time gates open to the public for that particular Game and ending at the time the last out is made in the bottom of the third inning of that Game. If for any reason the Entry Period for a particular Game commences but the Game is postponed or cancelled prior to the completion of six innings of play, then the Entry Period shall be deemed to have ended at such time as an announcement is made by the Rays over the Stadium's Public Address System that the Game has been postponed or cancelled, and the drawing will be held at such time later that date as the Sponsor shall determine in its sole discretion. A list of Games scheduled to be played at the Stadium during the Raffle Period and the time gates open to the public for each Game are available at www.raysbaseball.com or by telephone at (727) 825-3137 during the Sponsor's regular business hours (the "Sponsor Business Hours") as set forth in the Section entitled "Sponsor" below. Major League Baseball Game dates and times and gate opening times are determined in the sole discretion of the Office of the Commissioner of Baseball and/or the Tampa Bay Rays, as applicable, and are subject to change. If a scheduled Game is not played for any reason, there will be no Raffle conducted on the date of that Game.
ELIGIBILITY: At time of entry, entrants must be at least 18 years of age. Sponsor has the right to request photo identification from any person desiring to enter the Raffle. Raffle is void where prohibited by law, rule or regulation. All federal, state and local laws and regulations apply. Employees of Sponsor, and members of their immediate family and residents of their household, are not eligible to enter. "Immediate family" includes only an employee's spouse, parents, children and employee's siblings living in the same household.
TO ENTER: No purchase or contribution is necessary to enter or to win. To enter a Raffle, an eligible entrant must do at least one (1) of the following during the Entry Period of the Raffle he or she desires to enter
1. Go to any entry gate at the Stadium and scan a Rays Card registered with Sponsor under his or her name to gain entry to the Stadium for that Game using the Rays Card paperless ticketing system. It is the entrant's responsibility to properly load a valid ticket for that particular Game onto a Rays Card registered under his or her name and present it at the entry gate to be scanned at an RFID reader. If a ticket is not valid or is not properly loaded onto a Rays Card registered under entrant's name, or the Rays Card is not properly scanned and validated at an RFID reader, entry into the Raffle will be refused. Only the person to whom a Rays Card is registered according to the records of Sponsor at the time it is scanned for entry into the Stadium will be deemed to be entered into the Raffle for that Game, even if that person did not personally use the Rays Card to enter the Stadium.
2. Use a Rays Card registered with Sponsor under his or her name to make a total of at least $10 (ten dollars) in eligible concessions and/or merchandise purchases at participating stands at the Stadium that accept the Rays Card as a form of payment ("Qualifying Purchases"). It is the entrant's responsibility to properly load funds into the account associated with a Rays Card registered under his or her name and present it at the eligible concession or merchandise stand(s) as payment for the Qualifying Purchases. If funds are not properly loaded into the Rays Card account or the Rays Card is not successfully used to complete the Qualifying Purchases for any reason whatsoever, entry into the Raffle will be refused. Only the person to whom a Rays Card is registered according to the records of Sponsor at the time it is used to make the Qualifying Purchases will be deemed to be entered into the Raffle for that Game, even if that person did not personally use the Rays Card to make the Qualifying Purchases.
3. Go to the Gate 3 Membership Services Table described in the "Sponsor" section below and request and complete an Official Tampa Bay Rays "Tap to Win" Raffle Entry Form ("Entry Form"), and return it to an eligible Sponsor representative at the Gate 3 Membership Services Table. The Entry Form must be fully completed and include the entrant's valid name and contact information including current mailing address, phone number, and e-mail address. If an Entry Form is not fully and/or properly completed, is illegible, is not properly returned during the Entry Period, or is otherwise deemed ineligible in the sole discretion of the Sponsor, entry to the Raffle will be refused.
Eligible entrants may be entered into a Raffle a maximum of one (1) time per each method of entry, except that an entrant may be entered into a Raffle a maximum total number of two (2) times. No other method of entry will be accepted. Use of the Rays Card paperless ticketing system to enter the Stadium or use of a Rays Card to make purchases at the Stadium during the Raffle Period constitutes the entrant's full and unconditional agreement to and acceptance of these rules, terms and conditions, including all entry requirements. DRAWING AND NOTIFICATION OF PRIZE WINNER: Following the conclusion of the Entry Period, a random drawing of all eligible entries received during the applicable Entry Period will be held to select one entrant as the potential winner of the Raffle ("Potential Winner"). The name of the Potential Winner will be announced over the Stadium's Public Address System and shown on the Stadium Scoreboard (collectively, the "Notifications") prior to the beginning of the top of the seventh (7th) inning of the Game being played at the Stadium on that date. The Potential Winner will be directed via the Notifications to bring a photo identification to the Gate 3 Rays Card Services Table within thirty (30) minutes (the "Gameday Delivery Time") after the time the Notifications are made (said time being determined by the Sponsor in their sole discretion). Entrants need not be present to win. Following the Gameday Delivery Time, the Potential Winner will be notified at the e-mail address, postal address, and/or telephone number (in the sole discretion of Sponsor) under which his or her Rays Card account was registered with Sponsor at the time the Rays Card was scanned at a Stadium entry gate or used to make the Qualifying Purchases, or he or she provided on his or her Entry Form ("Additional Notification"). Upon presentation of valid photo identification, and subject to verification of eligibility and compliance with the terms of these Official Rules, the Potential Winner will be declared the winner of the Raffle ("Raffle Winner"). Sponsor will award the Prize (as defined herein) only upon verification of the Raffle Winner in Sponsor's sole discretion. Any transportation required for the Raffle Winner to receive the Prize shall be the Raffle Winner's sole responsibility and will not be furnished or paid for by Sponsor. If the Potential Winner has not complied with these Official Rules based on the sole discretion of Sponsor, the Prize will be forfeited and shall be retained by Sponsor. In the event the Potential Winner does not accept the Prize or is disqualified for any reason, the Grand Prize will be forfeited and shall be retained by Sponsor. In the event that any Potential Winner does not respond to the Notifications or Additional Notification within ten (10) days of issuance (the "Claims Period") for any reason whatsoever, a disqualification will result and the Prize (as defined herein) will be forfeited and shall be retained by Sponsor. Upon prize forfeiture, no compensation will be given to the potential winner. Decisions by Sponsor as to Raffle Winner eligibility and acceptance or disqualification will be final and binding.
If the Prize has not been awarded prior to the end of the Claims Period in accordance with the procedures set forth above, the Prize will be forfeited and shall be retained by Sponsor. The Prize will not be awarded to any other person. Sponsor will not be required to attempt to notify or locate the Potential Winner in any other manner other than by making the Notifications and Additional Notification. Sponsor also will not be responsible if the Potential Winner leaves the Game before the Notifications are made, is not in his or her seat when the Notifications are made, does not hear or see the Notifications, does not receive the Additional Notification, or is otherwise unaware that he or she may have the right to collect the Prize. If the Potential Winner attempts to collect the Prize after the end of the Claims Period, he or she will be notified that the Prize has been forfeited.
PRIZE: The Raffle Winner shall be entitled to receive, upon compliance with these Official Rules, the Prize designated for the Game played at the Stadium on the date they have been selected. One of the following will be awarded as the Prize (in the sole discretion of Sponsor) at each Game played at the Stadium during the Raffle Period:
PRIZE RESTRICTIONS AND ODDS: The Prize is not transferable or assignable and cannot be substituted for another prize. Any and all taxes, fees, and other costs including but not limited to federal and, if applicable, state and local income and withholding taxes that may arise and be due or asserted on the value of the Prize are the sole responsibility of the Raffle Winner. Odds of winning depend on the number of eligible entries received.
PUBLICITY RELEASE: The Raffle Winner agrees that acceptance of the Prize grants to Sponsor the right to print, publish, broadcast, and use world-wide, in any media now known or later developed at any time or times, the winner's name, portrait, picture, voice, likeness, and biographical information for any purpose, including but not limited to in advertisements, publicity, and other communications without additional compensation, except where prohibited by law.
RELEASE: As a condition of entering the Raffle, each entrant agrees that: (1) under no circumstances will the entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than actual out-of-pocket expenses, if any; (2) all causes of action arising out of or connected with the Raffle or any prizes awarded shall be resolved individually, without resort to any form of class action; and (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees and costs. BY ENTERING THE RAFFLE, THE RAFFLE WINNER AGREES TO RELEASE, DISCHARGE AND HOLD HARMLESS TAMPA BAY RAYS BASEBALL LTD., THE MLB ENTITIES (DEFINED BELOW), AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, FROM ANY AND ALL LIABILITY FOR ANY INJURY, LOSS, OR DAMAGE OF ANY KIND TO PERSONS, INCLUDING DEATH AND PROPERTY, WHETHER DIRECT OR INDIRECT, WHICH MAY BE DUE TO OR ARISE OUT OF PARTICIPATION IN THE RAFFLE OR THE ACCEPTANCE, USE, MISUSE, NON/USE, OR POSSESSION OF THE GRAND PRIZE, OR ANY PRIZE-RELATED ACTIVITY. As used herein, the "MLB Entities" shall mean MLB Advanced Media, L.P., the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc., Tickets.com, Inc., SportsOnEarth, LLC, the Major League Baseball Clubs, and each of their subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the directors, officers, employees and agents of the above entities.
DISCLAIMER: Sponsor is not responsible for any errors which may occur in connection with the administration of the Raffle, the processing of entries, the Notifications or the Additional Notification, any other announcements or telephone or in-person conversations relating to the Raffle or in any Raffle-related materials. The Sponsor reserves the right, in its sole discretion, to terminate, modify, or suspend any Raffles should Sponsor determine, in its sole discretion, that any virus, bug, non-authorized human intervention or other causes beyond its control have corrupted or affected the administration, security, fairness or proper conduct of the Raffle. In such case, the Sponsor will select the name of the Potential Winner from all eligible entries received prior to the aforesaid action taken by the Sponsor. Sponsor is not responsible for, and reserves the right to correct typographical, clerical or printing errors in any Raffle-related materials, including these Official Rules. Sponsor is not responsible or liable for any events beyond the control of Sponsor which may cause the Raffle to be stopped, including but not limited to any error, omission, interruption, deletion, defect, delay in operation or transmission, theft or destruction or unauthorized access to, or alteration of, entries, nor is Sponsor responsible for any failure to enter the Raffle on account of technical problems or human error, or any combination thereof. Sponsor may exclude, disqualify or terminate participation in the Raffle to any entrant who, in Sponsor's sole discretion: (a) ignores these Official Rules; (b) acts in a manner Sponsor determines to be not fair; (c) acts with an intent to annoy, threaten or harass any other entrant or the Sponsor; (d) acts in any other disruptive manner; or (e) tampers with the entry process. Sponsor reserves the right to make changes in the rules of the Raffle, which changes will become effective upon publication of revised Official Rules at www.raysbaseball.com.
CAUTION: ANY ACT OR ATTEMPT BY AN ENTRANT TO UNDERMINE THE LEGITIMATE OPERATION OF ANY RAFFLE MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL(S) TO THE FULLEST EXTENT PERMITTED BY LAW.
CHOICE OF LAW AND JURISDICTION: Except where prohibited by law, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrants, the potential winner and Sponsor in connection with any Raffle, shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Florida or any other jurisdiction) that might otherwise cause the application of the laws of any jurisdiction other than the State of Florida. Any action seeking legal or equitable relief arising out of or relating to any Raffle or these Official Rules shall be brought only in the courts of the State of Florida located in Pinellas County.
